How gratuity is calculated in the UAE
Full-time employees in the private sector who complete one year or more of continuous service are entitled to an end-of-service gratuity when their employment ends. It is based on the last basic salary, without allowances such as housing or transport.
| Length of service | Gratuity |
|---|---|
| Less than 1 year | No gratuity |
| First 5 years | 21 days' basic salary for each year |
| Each year after the first 5 | 30 days' basic salary for each year |
- Part years are paid in proportion to the time served.
- Days of unpaid absence are not counted as service.
- The total gratuity cannot be more than two years' wages.
- The employer must pay gratuity and other dues within 14 days of the contract ending.
Resignation and termination
Under the current law, gratuity is the same whether you resign or your employer ends the contract. The reduced rates for resignation, and the split between limited and unlimited contracts, come from the previous labour law, which was replaced in February 2022.
